Car Loans
Unlike a credit card debt, the debt you own on your car is considered a secured debt. You may keep any secured property in a Chapter 13 bankruptcy so long as you keep up your payments. If you own the car outright, you can probably still keep your car, depending on its value. Florida law partially protects a motor vehicle from unsecured creditor claims. Credit Card Debt and Bankruptcy
If you file a Chapter 7 bankruptcy, all of your credit card debt will be discharged. You legally do not pay anything more toward those debts.
If you file a Chapter 13 bankruptcy, you will pay a portion of the credit card debt, based on what you actually can afford to pay. This will be determined through a thorough analysis of your financial situation by your attorney in negotiation with the bankruptcy trustee. Your debt is consolidated and your payments are reduced.
Student Loans
Student loans cannot be discharged unless the loan is not secured or not from a government or nonprofit organization or repayment will cause extreme difficulties on the debtor and the debtor's dependent.
